Does the process really change depending on the profile?
The legal procedure is identical. The differences concern the documents: foreign criminal records and a notarial declaration of no bankruptcy for a non-resident, parent company documents for a subsidiary, professional qualification for certain activities. They also concern the bank and the manager’s social security.
Do I need to live in Luxembourg to set up a company?
No. The law requires neither nationality nor residence to be a partner or manager of a company in Luxembourg. An activity subject to a business permit does, however, require a fixed establishment in Luxembourg and a manager who effectively runs the business.
Do you give personal tax advice?
No. We coordinate the formation of the company and the formalities, whatever your profile. The founder’s personal taxation and the choice of a holding structure for the shares should be validated with a tax adviser before the process begins, as these are outside our coordination role.
